Terms of Service

These Terms of Service ("Terms") are an agreement between you and J. Klassen Inc., an Ontario, Canada corporation operating HostingFor.AI ("HostingFor.AI", "we", "us"). They cover your use of our website, hosting plans, domain registration, the AI publishing connector (MCP server), SFTP access and related services (the "Service"). By creating an account, starting a free trial or buying a plan, you agree to these Terms. If you're agreeing on behalf of a business, you confirm you're authorized to bind it, and "you" includes that business.

In short: plans renew automatically until you cancel, payments are non-refundable, and you may only use the Service for legal and ethical purposes. You are responsible for everything published to your site, including anything your AI assistant publishes.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. The Service is offered only to customers in North, Central and South America, the Caribbean and Oceania. You may not use the Service if you're barred from doing so under the laws of Canada or of the country where you live.

2. The Service

Depending on your plan, the Service includes: web hosting for static websites (HTML, CSS, JavaScript and media) or dynamic websites (PHP and MySQL); a subdomain of hostingfor.ai, or hosting for your own domain; domain registration on your behalf where your plan includes it; SSL certificates; DNS set-up; an MCP connector that lets AI assistants you authorize manage your site's files; and SFTP access. Email mailboxes are not included. We may add, change or remove features. If a change materially reduces what your paid plan includes, we'll tell you in advance.

3. Your account

  • Give us accurate, current information and keep it up to date. This includes the contact details used for domain registrations.
  • Keep your password secure. You're responsible for all activity under your account.
  • AI assistants and other tools you connect act on your behalf. Anything they do through the MCP connector, SFTP or other access (uploading, changing or deleting files, running code, changing settings) is treated as done by you. Review what your AI publishes. You can disconnect it at any time.
  • If you add other users to a site, you're responsible for their actions and for removing their access when appropriate.
  • Tell us right away at info [at] hostingfor [dot] ai if you suspect unauthorized access.

4. Plans, billing and automatic renewal

  • Prices are in US dollars. You'll be charged at the start of each billing term (monthly, quarterly or yearly) using the payment method on file, until you cancel.
  • Your plan renews automatically for the same term at the then-current price. If we change the price of your plan, we'll email you at least 30 days before the change affects your next renewal.
  • Canadian customers are charged GST/HST based on the province in their account. Our GST/HST registration number is 810891226 RT0001. You're responsible for any other taxes or duties that apply to you.
  • If a payment fails, we'll retry it and let you know. If it still hasn't been paid after 14 days, we may suspend your site. If it still hasn't been paid after 30 days, we may cancel your plan.
  • Payments are processed by Stripe. We don't store your full card number.

5. Free trials

Some plans include a one-month free trial. Trials are only available with a hostingfor.ai subdomain or a domain you already own. They're not available when we register a new domain for you. A valid payment card is required to start a trial. Unless you cancel before the trial ends, your card will be charged on the same day of the following month (or the last day of that month if it has no such day), and every billing term after that. Trials are limited to one per customer and per domain. We may refuse or end a trial if we suspect abuse.

6. No refunds

All payments are final and non-refundable. This includes partial billing periods, unused time after you cancel, charges after a free trial you didn't cancel, downgrades, and domain registration or renewal fees. This doesn't limit any rights you have under consumer protection laws that can't be waived by agreement.

7. Cancellation

You may cancel at any time from your account area or by emailing info [at] hostingfor [dot] ai. Cancellation takes effect at the end of your current paid term (or your trial). Your site stays online until then. After that, your hosting account and its files and databases are permanently deleted 30 days later. Please download anything you want to keep before then. If your plan ends because of non-payment instead, your site is suspended and we'll keep your files for a reasonable period so you can restore it by updating your payment method.

8. Domain names

  • Domains we register for you are yours. We register them on your behalf, through our registrar partner (Tucows/OpenSRS), with you as the registrant. You can point your domain somewhere else or transfer it away at any time. We'll give you the transfer authorization code when you ask for it.
  • Domain registrations are also governed by the registrar's and registry's agreements and policies, and ICANN policies (including the Registrants' Benefits and Responsibilities). You agree to those terms and to keep your registrant contact information accurate. Registries require this, and false information can lead to a domain being suspended or cancelled.
  • An included domain renews each year while your plan is active and paid up. If your plan ends, the domain stays registered to you until its current expiry date. After that, it's up to you to renew it (with us or another registrar) or let it expire.
  • Registries may restrict transfers for 60 days after a domain is registered or transferred. Availability shown during signup isn't guaranteed until registration is complete. If a domain can't be registered, we'll contact you so you can choose another.
  • For a domain you already own, you manage it at your own registrar, including renewing it and making the DNS changes we give you.
  • Subdomains of hostingfor.ai belong to us. They're provided for use with your plan, can't be transferred, and may be reassigned after your plan ends. We may reclaim a subdomain that's misleading, infringes someone's rights, or breaks these Terms.

9. Acceptable use

You may use the Service only for lawful and ethical purposes. You and anyone (or any AI) acting for you may not use it to host, send, link to or facilitate:

  • anything illegal where you are, in Canada, or where your site's audience is;
  • child sexual abuse material, or any sexualization of minors (we report this to authorities);
  • non-consensual intimate images, or content that harasses, threatens, bullies, doxxes or incites violence or hatred against people or groups;
  • fraud, scams, phishing, fake stores, deceptive impersonation of people or organizations, pyramid schemes, or fake reviews, records or credentials;
  • malware, exploit kits, botnet controllers, cryptocurrency mining, or attacks on any system, including scanning, brute-forcing or denial-of-service;
  • spam or unsolicited bulk messages, including through forms or PHP mail;
  • material that infringes copyright, trademark, privacy or other rights;
  • the sale of illegal goods or services, including regulated drugs, weapons, or unlicensed gambling;
  • open proxies, VPNs, file-sharing mirrors, or backup and storage that isn't part of your website;
  • collecting personal information without a clear privacy notice and whatever consent the law requires, or collecting payment card data outside a PCI-compliant payment provider.

You're responsible for the content, code and behaviour of your site, including anything generated or published by an AI tool. We don't review sites before they're published, but we may investigate complaints and remove content or suspend sites that break these Terms.

10. Resources and fair use

Each plan has limits on things like storage, bandwidth, CPU, memory, databases and email sending. These are designed for typical small-business websites. If your site uses so many resources that it affects the server or other customers, we may throttle, suspend or ask you to upgrade. Where practical, we'll let you know first.

11. Your content

You keep ownership of your content. You give us a limited license to store, copy, transmit and display it only as needed to provide the Service (including backups and technical operations). You confirm that you have the rights needed for everything you publish. To report content that infringes your rights, email info [at] hostingfor [dot] ai with enough detail for us to find and assess it.

12. Security and backups

We take reasonable steps to protect the servers and your data. You're responsible for the security of your own site code, forms, databases and passwords, and for keeping your own copies of your files and data. Any backups we keep are for our disaster recovery. We don't guarantee that they exist or that they can be restored for you.

13. Suspension and termination

We may suspend or end your access, without refund, if you break these Terms, don't pay, create a security or legal risk, or if we're required to by law or by a registrar or registry. We'll give notice where it's reasonable, but may act immediately to protect people, systems or our legal standing. We may also stop offering the Service. If we do that for reasons other than your breach, we'll give you at least 30 days' notice so you can move your site and domain.

14. Availability

We work to keep the Service running, but don't guarantee any particular uptime. The Service may be interrupted for maintenance, updates, failures of third parties, or events outside our control.

15. Third-party services

The Service depends on third parties, including Stripe (payments), Tucows/OpenSRS (domains), our infrastructure and email providers, and the AI assistants you choose to connect. Their services are governed by their own terms. We aren't responsible for how an AI provider processes what you share with it, or for the output it generates.

16. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. This includes fitness for a particular purpose, merchantability and non-infringement.

17. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the affected site in the three months before the claim arose.

18. Indemnity

You agree to defend and indemnify J. Klassen Inc. and its directors, employees and contractors against claims, losses and costs (including reasonable legal fees) arising from your content, your site, your use of the Service (including by AI assistants or users you authorize), or your breach of these Terms or the law.

19. Privacy

Our Privacy Policy explains how we handle personal information.

20. Changes to these Terms

We may update these Terms. For material changes, we'll email you or post a notice at least 30 days before they take effect. If you keep using the Service after changes take effect, you accept them. If you don't agree, you can cancel before then.

21. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction, unless consumer protection law where you live gives you the right to bring a claim there.

22. General

These Terms (with the Privacy Policy and any plan details shown at checkout) are the entire agreement between us about the Service. If any part is found unenforceable, the rest still applies. Our not enforcing a term isn't a waiver of it. You may not transfer your account without our consent. We may assign these Terms as part of a reorganization or sale of our business.
